1. Introduction

Welcome to GigMedia, owned and operated by HKI Media Pvt. Ltd. (formerly Maa Boli Entertainment Pvt. Ltd.), having its registered office at Gurugram, Haryana, India. These Terms of Use (“Terms”) form a legally binding agreement between you (“User”, “You”) and HKI Media (“GigMedia”, “We”, “Us”). By accessing or using the GigMedia App, you agree to these Terms.

2. Scope of Terms

These Terms apply specifically to the Media Professionals section of the GigMedia App. By using this section, you agree to comply with all applicable policies, features, and guidelines.

3. About GigMedia

GigMedia is a technology platform for the media and creative ecosystem, enabling professionals to:

• Showcase portfolios
• Connect and collaborate
• Discover opportunities
• Build sustainable careers

4. Eligibility

To use GigMedia, you must:

• Be 18 years or older (or have parental consent)
• Have legal capacity to enter into a binding agreement
• Provide accurate and complete information
• Be a legitimate media/creative professional

GigMedia reserves the right to verify user identity and deny access if eligibility is not met.

5. Account Registration & Verification

• Users must create an account to access key features.
• You may be required to submit documents (ID, portfolio, certifications, etc.).
• You are responsible for maintaining the accuracy and confidentiality of your account.
• Misrepresentation or fake profiles may lead to account suspension or termination.

GigMedia supports a wide range of professionals across:

Film, TV, Photography, Production, Journalism, Content Creation, Animation, VFX, Gaming, Music, Performing Arts, Marketing, Events, and Media Management (Collectively referred to as “Media Professionals”).

By uploading content on GigMedia, you retain ownership of your work but grant GigMedia a worldwide, non-exclusive, royalty-free license to display and promote your content, and use it for marketing, product improvement, and platform growth. You confirm that you have rights to all content you upload.

9. Payments & Fees

• Some features may require subscription or service fees.
• Fees will be clearly displayed before purchase.
• Payments are processed via third-party providers.
• Subscriptions may auto-renew unless cancelled.
• Fees are generally non-refundable, unless required by law.

10. Data & Privacy

By using GigMedia, you consent to the collection and processing of personal and usage data, sharing data with service providers for platform functionality, and the use of data for analytics and personalization.

11. Data Security

GigMedia uses industry-standard security measures. However, you are responsible for safeguarding your account. We cannot guarantee complete protection from cyber threats. Use the platform at your own risk.

12. Third-Party Services

GigMedia may integrate third-party tools. We are not responsible for third-party services, policies, or failures.

13. Termination

We may suspend or terminate your account for violations of these Terms, unlawful activity, or providing false information. You may delete your account at any time.

14. Limitation of Liability

GigMedia is provided as is without warranties. We are not liable for loss of data, revenue, or platform downtime. Maximum liability is limited to fees paid in the last 6 months.

15. Indemnification

You agree to indemnify GigMedia against any claims arising from your use of the platform, your content, or your violation of these Terms.

16. Modifications

We may update these Terms at any time. Continued use of the platform means you accept the updated Terms.

17. Governing Law

Governed by the laws of India. Disputes resolved via arbitration in Delhi. Courts in Delhi shall have jurisdiction.
